Right to information (RTI) applications

You have the right to ask what information we hold about you by filling out a Right to Information (RTI) application. RTI applications take up to 7 weeks to process.

About your application

Two laws support your application.

If you want to find out information that is a mix of personal and non-personal, it will be processed under the Right to Information Act 2009 (RTI Act).

If your application is only about personal information, it is covered by the Information Privacy Act 2009 (IP Act).

The same form works for both types of enquiries.

Application fee

If you want to find out a mix of personal and non-personal information, you must pay an application fee of $55.75 before it can be processed. The fee generally increases from 1 July each year.

The RTI Act restricts us from waiving the application fee in any circumstances.

There is no charge if you only want to find out personal information.

If you think your application is only for personal information and we find it needs mixed information, we will contact you to ask for payment. You will need to pay before we process your application.

Payment

We do not accept payment by credit card.

Payment can be made by:

Processing fee

If we spend less than 5 hours processing your application, there is no charge. 

If we need more than 5 hours, a processing charge applies to every hour we work for you.

We charge $8.65 for every 15 minutes we spend on your application.

Estimate before going ahead

If we assess that your application requires charges, we will estimate these costs for you before we process your application.

You can change the scope of your application to save money if you wish.

Access charge

We are a digital-first agency, so we convert all paper applications into digital files.

If you supply us with information by USB, CD or email, you will not need to pay an access charge.

If you supply us with documents as photocopies, we will charge you 25 cents per page.

Personal information documents

If your RTI application includes documents that contain your personal information, we will not charge you any processing fees for those documents.

Waiving fees and charges

We can waive fees and charges for three reasons:

  1. We think the cost will be uneconomical to charge.
  2. You hold a concession card.
  3. Your organisation is not-for-profit or in financial hardship.

What happens next?

We will let you know whether your application is valid.

If you are not satisfied, you can ask for an internal review or an external review by the Office of the Information Commissioner.
